Scope
These general terms and conditions apply to all orders placed through the online shop of Fluna Tec & Research GmbH, Dr.-Hans-Lechner-Straße 6, 5071 Wals-Siezenheim, Austria (hereinafter “we”). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
Formation of the contract
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By submitting your order via the “Buy now” button, you make a binding offer to conclude a contract of sale. The contract is concluded when we accept your order by means of an order confirmation sent by email or when we dispatch the goods. The automated acknowledgement of receipt merely documents that your order has been received.
Prices and payment
All prices include the statutory value added tax applicable in the country of delivery, plus shipping costs in accordance with the page Shipping & Payment. The payment methods listed there are available (card, Apple Pay, Google Pay, PayPal, Klarna, eps). We reserve the right to exclude individual payment methods in specific cases.
Delivery
We deliver to the member states of the European Union. Items in stock are generally handed over within 24 hours (on working days); the delivery times for each destination country can be found under Shipping & Payment. If an item is temporarily unavailable, we will inform you without delay; any payments already made will be refunded immediately in such cases.
Retention of title
The goods remain our property until payment has been made in full.
Right of withdrawal and returns
Consumers are entitled to the statutory right of withdrawal of 14 days – all information, including the model withdrawal form, can be found in our Withdrawal Policy. In addition, we grant a voluntary right of return of 30 days for unopened, unused goods.
Warranty
The statutory warranty rights apply. For consumers, the warranty period is two years from handover of the goods. Please address any complaints to office@flunatec.com.
Liability
We accept unlimited liability for damage resulting from injury to life, body or health, as well as in cases of intent and gross negligence. In cases of slight negligence, we are liable only for the breach of material contractual obligations and only up to the foreseeable damage typical of this type of contract. Liability under the Produkthaftungsgesetz (Austrian Product Liability Act) remains unaffected.
Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. If you have any concerns, you can always contact us directly at office@flunatec.com.
Applicable law and place of jurisdiction
Austrian law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). Vis-à-vis consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the country of their habitual residence. For transactions with entrepreneurs, the place of jurisdiction is Salzburg.
